Terms of Service
Last updated October 24, 2026
These terms govern use of macherald.com and the dedicated Mac hosting service offered by MacHerald, a service of Even Flow Solutions LLC ("MacHerald", "we", "us"). By using the site or the service, you agree to these terms.
The Service
MacHerald rents dedicated Apple Mac mini computers hosted in a data center, with remote administrator access. Plan specifications and prices are listed on the site and may change. Price changes for an active plan take effect at the next billing period after notice.
Waitlist
Joining the waitlist is free and does not create a contract or guarantee that a Mac will become available by any date. We contact people on the waitlist as Macs become available.
Billing and Cancellation
Plans are billed monthly in advance, with no long-term contract. You can cancel at any time, and the cancellation takes effect at the end of the current billing period. Fees already paid are not refunded except where required by law.
Acceptable Use
You are responsible for everything that runs on your Mac. You may not use the service to:
- break the law or infringe the rights of others;
- send spam, run phishing, or distribute malware;
- attack, scan, or disrupt other networks or systems;
- mine cryptocurrency; or
- interfere with the data center, other customers, or MacHerald infrastructure.
You must follow the Apple software license agreements that apply to macOS, Xcode, and other Apple software you use.
Your Data
You keep all rights to your data. You are responsible for backing it up. When a plan ends, we erase the Mac before giving it to another customer, and data on it cannot be recovered.
Availability
We work to keep the service running, but we do not guarantee uninterrupted availability. We may perform maintenance and will try to give notice when it affects your Mac.
Suspension and Termination
We may suspend or end the service if you breach these terms, fail to pay, or put the service or others at risk. Where practical, we will give notice first.
Disclaimers
The service is provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law.
Limitation of Liability
To the fullest extent permitted by law, MacHerald is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost data or profits. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.
Governing Law
These terms are governed by the laws of the State of New York, without regard to conflict of law rules. Disputes will be resolved in the state or federal courts located in New York County, New York.
Changes
We may update these terms. The date at the top shows the latest version. Continued use after an update means you accept the new terms.
